Terms of Use

Last updated: 20 October 2026

These terms apply to your use of the website at thekairosark.org and to any services we provide to you. Please read them before submitting an enquiry or engaging us.

1. Who we are

The Kairos Ark (Pty) Ltd, registration number 2026/706945/07, Sandton, Johannesburg, South Africa (“we”, “us”).

2. Website use

The website is for information about our services. Case studies, sample reports, dashboards and illustrative examples are provided to show our methods and format. They are not guarantees of results and must not be relied on as evidence of any company’s performance.

3. Enquiries, scoping and quotes

4. Payment

Invoices are payable within 7 days of the invoice date unless the statement of work says otherwise. Late payments may attract interest at the prescribed rate and may cause us to suspend services after reasonable notice. Fees are shown excluding VAT.

5. Nature of the services

Social listening, consumer research and influencer intelligence rely on public information and on third-party platforms. Coverage, access, timing and data availability can change without notice, and not every conversation can be captured. Our services support decisions; they do not guarantee commercial outcomes, prevent crises, or replace your own legal, financial, regulatory or medical advice.

6. Data and content you provide

You confirm that the instructions, brand names, keywords and other material you give us are lawful to use, and that you have the rights needed to use our deliverables. You must not use our deliverables to identify, contact, target or profile private individuals, or to make decisions about individuals that they cannot challenge.

7. Intellectual property

Our methods, tools, templates and pre-existing materials remain ours. On full payment of the agreed fees, you receive a non-exclusive licence to use the deliverables for your internal business purposes, unless the statement of work says otherwise. Public content we collect remains subject to the terms of the platforms it came from.

8. Confidentiality

Each party will keep the other’s confidential information private and use it only for the engagement, except where disclosure is required by law or is already public.

9. Privacy

How we process personal information is set out in our Privacy Policy, which forms part of these terms.

10. Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential loss, lost profit or loss of opportunity arising from use of our services or website. Our total liability for a claim arising from an engagement is limited to the fees paid to us under that engagement in the three months before the claim arose.

Nothing in these terms limits any right you have under the Consumer Protection Act 68 of 2008 where that Act applies to you, or any liability that cannot lawfully be limited.

11. Termination

Either party may end an ongoing engagement by giving [NOTICE PERIOD] days’ written notice unless the statement of work says otherwise. Fees for work performed up to termination remain payable. Either party may end an engagement immediately for a material breach that is not remedied within 14 days of written notice.

12. Changes

We may update these terms. Changes apply to engagements from the date we publish them, unless we agree otherwise in writing.

13. Governing law and disputes

These terms are governed by the laws of the Republic of South Africa. The parties will first try to resolve any dispute in good faith. If that fails, the Gauteng Division of the High Court of South Africa, Johannesburg, has jurisdiction, subject to any right to approach a different forum that the Consumer Protection Act gives you.
